  1. Cummins Inc has tentatively agreed to pay a record $1.675 billion fine for violating the Clean Air Act by installing “defeat devices” on engines, enabling excess emissions of pollution.
  2. The company allegedly utilized these devices on hundreds of thousands of engines, including RAM pickup trucks from 2013 to 2019 and 2019 to 2023 models, to bypass emissions controls.
  3. U.S. Attorney General Merrick Garland stated that this use of defeat devices led to thousands of tons of excessive nitrogen oxides emissions, making it the second-largest environmental penalty in history.
  4. Cummins anticipates a significant charge of around $2.04 billion in the fourth quarter to settle regulatory claims related to nearly one million engines, emphasizing it has found no evidence of bad faith and does not admit wrongdoing.
